The City of Huntington denied my public document request for internet usage for suspended police detective Mel Hunnicutt. It is probably safe to assume the same request for Trent Ruble will also be denied. Read the city's response below and the specific cases cited in the denial:

The City's response lists three reasons for the denial:
1. This request does not identify with reasonable particularity the records being requested. Indiana Code 5-14-3-3 (a)
2. The general internet history of a public employee or official is not public record. See Informal Opinion (John Rowe) of the Public Access Counselor dated January 4, 2008.
3. The City does not maintain a record or list of website hits; rather, such a list would need to be created. A request for research and development of a record, not already maintained is an exception to the statutory disclosure requirements. Nothing in the statute requires a public agency to develop records or information pursuant to a request. See Opinions of the Public Access Counselor 07-FC-155.
